Privacy policy

How personal data is handled on this website, on what legal basis, and what rights you have.

1. Controller

yawusa UG (haftungsbeschränkt), Schliemannstraße 23, 10437 Berlin, Germany.

Phone: +49 30 754 202 99 · Email: info@agentificacion.com

The company is based in Germany. Processing is therefore governed by the European Union General Data Protection Regulation (GDPR), regardless of the country you access the site from.

2. Data processed

  • Technical access data your browser necessarily transmits: IP address, date and time, requested page, referrer, browser type and operating system.
  • Your choice in the consent banner, stored in a single technical cookie.
  • Aggregated, anonymous audience statistics — only if you consent.
  • Any data you provide voluntarily when you email or call us.
  • The data you enter when booking a call: name, email address, time zone and the slot you pick.

3. Purposes

  • Technical delivery of the website and infrastructure security.
  • Recording and honouring your decision on audience measurement.
  • Aggregated measurement of site reach, subject to consent.
  • Arranging and holding appointments you book.
  • Answering your enquiry and preparing a possible contractual relationship.

4. Legal bases

  • Art. 6(1)(a) GDPR: consent (audience measurement).
  • Art. 6(1)(b) GDPR: performance of a contract and pre-contractual steps.
  • Art. 6(1)(c) GDPR: compliance with a legal obligation.
  • Art. 6(1)(f) GDPR: legitimate interest in secure and stable operation of the website.

5. Hosting

The site is hosted by Vercel Inc., 340 S Lemon Ave #4133, Walnut, CA 91789, USA, acting as a processor under a data processing agreement pursuant to Art. 28 GDPR. Delivery runs through an EU region.

Vercel processes the technically necessary access data described in section 2 in order to deliver the site and keep it secure. The legal basis is our legitimate interest in secure and efficient provision (Art. 6(1)(f) GDPR).

6. Cookies, consent and audience measurement

We use cookies sparingly. The only technically necessary cookie belongs to our consent tool (Klaro) and stores the choice you make in the banner for 180 days. Klaro is self-hosted; no external provider is called.

To measure site reach we use Plausible Analytics, a cookieless solution we operate ourselves on servers in Germany (Hetzner Online GmbH). Plausible builds no cross-device profiles, passes no data to third parties or outside the EU, and does not store the IP address. Only aggregated, anonymous statistics are produced.

Audience measurement is activated only after your explicit consent via the banner. The legal basis is your consent (Art. 6(1)(a) GDPR in conjunction with § 25(1) TDDDG). You can withdraw it at any time with effect for the future via the privacy preferences in the footer.

7. Appointment booking

We use Cal.com to schedule calls, self-hosted by us on the same server in Germany as the rest of our services. No external provider is involved and no data is passed to third parties.

When you book, we process the data you enter in the form — name, email address, time zone and, if you provide it, the subject of your enquiry — together with the date and time you select. The purpose is to arrange and hold the appointment.

The legal basis is pre-contractual steps taken at your request (Art. 6(1)(b) GDPR). Data is retained for as long as needed for the appointment and any follow-up, and for any applicable statutory retention periods.

8. Transfers to third countries

Vercel Inc. (USA): delivery runs through an EU region, but because the parent company is US-based, access from the United States cannot be ruled out. The transfer is safeguarded by EU standard contractual clauses and the EU-US Data Privacy Framework.

Audience measurement (Plausible) runs exclusively on servers in Germany; no third-country transfer takes place there.

9. Recipients

Your data is disclosed to third parties only where there is a legal obligation, where you have consented, or to processors — in particular the hosting provider — on the basis of an agreement under Art. 28 GDPR. All processors are contractually bound to comply with the GDPR.

10. Social media links

Links to our social media profiles are plain links. No plug-ins are loaded and no data is transmitted to those platforms until you click. From that point the respective provider’s privacy policy applies.

11. Retention

Access data is retained only as long as needed to keep the service secure, then deleted. The consent cookie expires after 180 days. Correspondence is kept for as long as needed to handle your enquiry and for any applicable statutory retention periods.

12. Your rights

To exercise them, write to info@agentificacion.com.

  • Access to the personal data we process about you (Art. 15 GDPR).
  • Rectification of inaccurate data (Art. 16 GDPR).
  • Erasure (Art. 17 GDPR).
  • Restriction of processing (Art. 18 GDPR).
  • Data portability (Art. 20 GDPR).
  • Objection to processing based on legitimate interest (Art. 21 GDPR).
  • Withdrawal of consent at any time with effect for the future (Art. 7(3) GDPR).

13. Security

Transmission is encrypted using TLS. We apply appropriate technical and organisational measures to protect data against manipulation, loss and unauthorised access, and review them regularly.

14. Right to lodge a complaint

You have the right to lodge a complaint with a data protection supervisory authority. The authority responsible for us is:

Berliner Beauftragte für Datenschutz und Informationsfreiheit

Friedrichstr. 219, 10969 Berlin, Germany

Phone: +49 30 13889-0

Email: mailbox@datenschutz-berlin.de

15. Changes to this policy

We reserve the right to update this privacy policy when the applicable law or the scope of our services changes.
